Article 1: Price

The prices of our products are indicated in euros, inclusive of all taxes for all orders intended for individuals, and exclusive of taxes for all orders intended for professionals.

TEM reserves the right to modify prices at any time, but products will be invoiced based on the rates in effect at the time of order validation.

Article 1.1: Wedding, Anniversary, and Corporate Collections

The first five mailings are offered “for trial” and do not require any purchase obligation. If a mailing order is placed before sending these 5 trial versions, the latter will be forfeited.

The rates are decreasing, including card customization and tracking of mailings.

TEM cannot be held responsible for the non-opening of your message by the recipient, and this will not result in a refund or deduction of the mailing. Sending to the same recipient will count as two mailings.

To place an order, the User must purchase a “number of mailings.” When a product is sent, the deducted mailings correspond to the number of mailings performed.


Article 2: Terms Applicable to Ordered Content

Article 2.1: Order and Validation

The client's payment for the order constitutes total and unreserved acceptance of the general terms of sale. No modification to the order may occur once validation has been completed.

The ability to send your product will occur after payment validation.

The Company strives to maintain access to its websites 24 hours a day; however, its liability cannot be engaged in the event of a service interruption, notably for reasons of maintenance or technical problems. The client acknowledges the technical limitations of internet technologies, particularly concerning the consultation of information, file transfers, and risks associated with this technology.

Any cancellation of an order can only occur after acceptance by the Company and will be confirmed in writing via email.

By placing an order on this Site, you guarantee that you have all the rights, permissions, and authority necessary to place the order. You authorize the Company to copy, modify, create templates and derivative works, and vectorize any content uploaded by you, for the purposes of fulfilling your order. Article 2.2: Terms Relating to Ordered Content

You are personally responsible for the use of the Content, especially when it has been customized with images, graphics, text, or other elements.

You agree not to use our services to distribute Content that is illegal, harassing, defamatory, and/or slanderous, threatening, harmful, obscene, malicious, or otherwise objectionable.

You also agree not to include in your Content any text, image, drawing, trademark, or service mark, or any work for which the intellectual property rights belong to any third party, without first obtaining the appropriate permissions from the rights holders. As such, you guarantee that your Content will not infringe on any third-party rights, including intellectual property rights, trademarks, personality rights, and privacy rights; that they will not slander or defame any third party; and that you have all the required rights or permissions necessary to incorporate them into your Content.

The Company reserves the right to suspend Orders suspected of not complying with these content-related conditions. In such cases, the suspension of services is valid only for the affected Order and may be lifted at the sole discretion of the Company upon receipt of evidence demonstrating compliance with our content-related conditions.


Article 3: Order Processing

Article 3.1: Wedding, Anniversary, and Corporate Collections

Validating your order online constitutes acceptance of its contents. It cannot be modified thereafter.


Article 4: Payment

Payment by credit card (via a secure site) is offered.

The processing of the customer's order will only be executed once the payment has been validated by banking institutions.


Article 5: Withdrawal - Satisfaction or Refund

In accordance with current legal provisions, the buyer should have a period of 14 days from the date of their order to exercise their right of withdrawal. However, in accordance with Article L 121-20-2 of the French Consumer Code, "customized" products cannot be refunded.

In the event of a complaint, refer to Article 6 of the General Terms of Sale.


Article 6: Complaints

If, despite the attention paid to the order, the customer is not satisfied due to a problem exclusively attributable to TEM (limited to: photos or text not conforming to the proof validated by the customer online), the customer has 14 calendar days from the date of the order to submit a complaint. After this period, the order will be considered definitively accepted by the customer. A justified complaint determined by TEM will result either in the free modification of the defective card, or a refund may be offered within 15 days.


Article 7: Intellectual Property

All illustrations, photographs, graphics, and text present on this site are strictly reserved under copyright and intellectual property laws. Any reproduction of elements found on www.birdpostal.com is strictly prohibited.


Article 8: Personal Information

The information and data concerning the client are necessary for order management and commercial relations.

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify, and oppose the personal data concerning you.
